TERMS AND CONDITIONS BETWEEN AND GM RECRUITING CC (GLOBAL MEDICAL RECRUITING)

GENERAL PROVISIONS:

• 1. The Candidate voluntarily presents himself/herself and submit his CV and other relevant document to be submitted to all employers with suitable vacancies as identified by GM Recruiting.
• 2. GM Recruiting confirms it has access to prospective employers who, with vacancies that may match the qualifications and experience of The Candidate.
• 3. GM Recruiting cannot guarantee to find a suitable placement, including compensation and payment, for The Candidate.
• 4. The decision to accept any placement / contract lies solely with The Candidate.
• 5. The Candidate shall present GM Recruiting with all information and documents as may be requested on the sole discretion of GM Recruiting and The Candidate consents to the utilization and publication of any and all such information presented, to be used and revealed to any prospective employer.
• 6. The Candidate shall not contact the prospective employer directly for any reason prior to reporting for the position, without prior written consent from GM Recruiting.
• 7. GM Recruiting and The Candidate record that The Agent did not receive any payment of any amount in the form of a fee from The Candidate for performing the service.

FEES AND TERMS OF PAYMENT:

• 8. GM Recruiting records that it has entered into an undisclosed agency fee agreement with prospective employers, of which The Candidate is not a party to, and The Candidate has no claim against GM Recruiting for any payment in terms of the Agency fee agreement between.

DISCLAIMER:

• 9. The information made available by GM Recruiting to The Candidate and any other candidate on or through its website and any correspondence and documents exchanged, is intended to provide general information to The Candidate.
• 10. The Candidate confirms that all information provided to GM Recruiting is a true reflection of their actual experience, qualifications and that all and documents provided to GM Recruiting is accurate and true.
• 11. The parties further record that:
• a. GM Recruiting made no warranty, express or implied, nor assumes any legal liability or responsibility for the accuracy, correctness, completeness or use of any information that is available on or through its website or any other information presented to The Candidate by GM Recruiting.
• b. GM Recruiting may change, delete, add to, or otherwise amend information contained without notice.
• c. The contents of GM Recruiting's website and correspondence should not be construed as legal, business or tax advice and The Candidate should take specific advice from qualified professional people before undertaking any action following information received from GM Recruiting.
• d. Any reference to any specific information received from the GM Recruiting, including information pertaining to the commercial product, process, or service by trade name, trademark, business entity, or otherwise does not constitute an endorsement, recommendation, or favoring by GM Recruiting.
• e. Should The Candidate ignore this disclaimer he/she does so at his/her own risk.

CONFIDENTIALITY:

• 12. GM Recruiting will exercise reasonable efforts to ensure that The Candidate information remains confidential and is available only to personnel who have a need to know such information in connection with providing The Candidate with GM Recruiting's services or otherwise for GM Recruiting's general business purposes, and will not sell The Candidate name, address or similar personally identifying information to unrelated third parties or permit the use of such information outside the scope of GM Recruiting's service or general business purposes.

INDEMNIFICATION:

• 13. The Candidate shall indemnify and save harmless GM Recruiting and employees from all suits, actions, losses, damages, claims, or liability of any character, type of description, including without limiting the generality of the foregoing all expenses of litigation, court costs, and attorney's fees arising from or relating to GM Recruiting's performance of the terms of this Agreement.

TERMINATION:

• 14. Should any 3rd party prospective employer, at any stage, retract any offer made to The Candidate or to terminate the appointment in the position in terms of the agreement between the 3rd party employer and The Candidate, such termination of the appointment in the position in terms of the agreement between the 3rd party employer and The Candidate shall result that The Candidate has no recourse of claim against GM Recruiting of any nature whatsoever whether arising out of award, contract, delict or statute.
